Resumen EjecutivoMucho se ha dicho sobre la Reforma Constitucional
en Derechos Humanos del 2011. Principalmente, el
análisis se ha enfocado en las virtudes jurídicas de
la Reforma como nuevo paradigma constitucional.
Una vez más, el análisis positivista de las normas
constitucionales ha prevalecido. No obstante, poco
se ha escrito de los efectos prácticos que la Reforma
ha traído en la vida cotidiana de las personas que se
encuentran en territorio nacional, especialmente
de aquellas que se encuentran en situación de
vulnerabilidad, como las personas migrantes. Del
mismo modo, la mirada de análisis de la Reforma
ha tenido, en general, una perspectiva central y
jurídica, que asume que la realidad del país es
aquella de su capital y que marcan las normas
escritas.
Este documento pretende contribuir a virar el
análisis de la Reforma Constitucional en Derechos
Humanos del 2011 hacia un plano práctico y
nacional, desde la mirada de organizaciones de
la sociedad civil que trabajan el tema migratorio.
Para ello, se convocaron 5 grupos de análisis
conformados por organizaciones de la sociedad
civil, activistas y expertos en el tema migratorio de
distintas partes de la República Mexicana.
Entre los principales hallazgos de este proceso de
trabajo destaca que para las organizaciones que
trabajan temas migratorios, el proceso de incidencia
durante la Reforma estuvo considerablemente
concentrado en el Distrito Federal. Lo anterior
puede ser una explicación al bajo conocimiento
del contenido y de los alcances de la Reforma
Constitucional en Derechos Humanos que indicaron
tener las organizaciones que trabajan temas
migratorios. Ante esta realidad, el documento
sugiere que la apropiación de la ciudadanía de la
Reforma Constitucional es indispensable para el
éxito de la Reforma.
Debe existir una participación activa por parte de
la ciudadanía no sólo del centro del país, sino de
las entidades federativas, para conocer la Reforma
y exigir a las autoridades su cumplimiento. Esto
incluye un conocimiento extenso de la Reforma y
no sólo limitarse al conocimiento del artículo 1º
constitucional.
En la medida que los ciudadanos, y no sólo los
abogados, hagan suya la Reforma, podemos
comenzar a hablar de avances en las situación
de Derechos Humanos del país. Es importante
destacar que este documento no demerita ni los
análisis jurídicos, ni las virtudes de la Reforma.
No obstante, se considera que la Reforma
Constitucional es un punto de partida y no un puerto
de llegada. Aún existen diversos temas pendientes,
por ejemplo, emisión de legislación secundaria,
implementación ejecutiva y judicial de la Reforma
así como la supervisión nacional e internacional
de su aplicación. En tanto estos aspectos no sean
cubiertos será difícil afirmar que la Reforma ha
cambiado la realidad social de México.
IntroducciónEl 10 de junio de 2011 se publicó en el Diario
Oficial de la Federación (DOF) una Reforma de
diversas disposiciones constitucionales en materia
de derechos humanos (Reforma Constitucional en
Derechos Humanos). Al respecto, se ha convertido
en un lugar común afirmar que la Reforma
Constitucional en Derechos Humanos es un avance
importante para la promoción y protección de los
derechos humanos en México. 1 Sin embargo, a
dos años de esta Reforma es importante analizar
los efectos prácticos, beneficios y limitaciones que
ésta ha tenido. Por ejemplo, tal como será discutido
más adelante, en el aspecto migratorio aún no se
han logrado obtener resultados que favorezcan a
las personas migrantes.2
Ante esta situación, el Instituto de Investigaciones
Económicas de la Universidad Nacional Autónoma
de México y Sin Fronteras IAP, en conjunto la
Unión Europea, como financiadora, decidieron
unir esfuerzos para realizar un análisis de los
alcances de la Reforma Constitucional en Derechos
Humanos, especialmente, en materia migratoria y
así encontrar los retos a los que nos enfrentamos y
sus posibles soluciones. 3

Este documento contiene un estudio sobre los
alcances y retos de la Reforma constitucional en
derechos humanos a la luz del marco normativo
actual en materia migratoria. Para ello, el
documento se divide en cinco secciones. La primera
sección contiene una nota metodológica sobre el
proyecto; la segunda una breve descripción sobre
qué es la Reforma y cómo se llegó a ésta; la tercera
sección contiene los retos y reflexiones a dos años
de la Reforma; la cuarta sección contiene un análisis
teórico de los artículos 11 y 33 constitucionales
y, finalmente, la quinta sección contiene las
conclusiones.

(I) Nota metodológica
Para analizar el impacto y alcance de la Reforma Constitucional en materia de Derechos Humanos en
relación al tema migratorio, en este proyecto se fomentó el análisis participativo. El propósito de esta
etapa del proyecto fue incrementar la articulación e intercambio de información entre organizaciones
de la sociedad civil, la academia y especialistas a nivel nacional y así conocer los retos e implicaciones
de la Reforma.
Durante el proyecto se convocaron 5 grupos de análisis conformados por organizaciones de la
sociedad civil, activistas y expertos en el tema migratorio de distintas partes de la República Mexicana.
Se analizó el marco normativo actual en materia migratoria a la luz de la Reforma Constitucional en
Derechos Humanos.
Se buscó tener el mayor número de participantes de diversas partes de la República en los grupos de
análisis, con el fin de tener la mayor información sobre los retos, alcances e impactos de la Reforma
y la percepción proveniente de la sociedad civil. Durante la planeación de los grupos se intentó que
el impacto fuera lo más alto posible. Por esta razón se emitieron un gran número de invitaciones a
organizaciones de la sociedad civil que pudieran estar interesadas en los temas relacionados con los
grupos de análisis. Sin embargo, las agendas de muchos invitados no coincidían con las fecha de los
foros, pero sí se logró convocar a un número representativo de organizaciones de la sociedad civil
especialistas en materia migratoria.
Se contó con la participación de 56 asistentes a los grupos de análisis y al foro de académicos. Estos
participantes fueron del Baja California, Chiapas, Distrito Federal, Guadalajara, Guanajuato, Querétaro,
Saltillo, Veracruz y Zacatecas.4
Durante la realización de los grupos de análisis, se dividió a los asistentes en cinco grupos. Uno de
ellos tuvo participantes de la región norte del país, otro de la región sur, uno de la región centro y se
tuvieron dos grupos con participantes de distintas regiones. Una cuestión fundamental durante el
desarrollo de los grupos de análisis fue una presentación del contenido de la Reforma, para realizar las
reflexiones en los grupos focales.
Uno de los datos más relevantes recolectados en los grupos de análisis es que el 40.63% de las OSCs
participantes no conocían la Reforma en su totalidad y sólo el 59.37% tenía un conocimiento más
amplio. Este desconocimiento del contenido de la Reforma fue un obstáculo para la identificación de
los problemas de fondo que la Reforma presenta. Dada esta situación, se decidió realizar un foro en el
que hubiera un panel integrado por académicos expertos en la materia para que explicarán de forma 4 Se puede observar esto en listas de asistencia.
más detallada y precisa todos los aspectos relevantes de la Reforma y tuvieran una interacción directa
con las OSCs. Este foro funcionó como cierre de reflexión de los grupos de análisis. Los ponentes
participantes del foro fueron:

(II) ¿Qué se reformó y cómo se reformó?
A. Contenido de la Reforma
La Reforma Constitucional en de Derechos Humanos modificó los artículos 1, 3, 11, 15, 18, 29, 33, 89,
97, 102 y 105 de la Constitución Política de los Estados Unidos Mexicanos.5 En el siguiente cuadro se

B. La sociedad civil y el proceso de Reforma: algunos aspectos relevantes
Durante el proceso de la Reforma Constitucional, algunos legisladores (tanto de la Cámara de Diputados
como de Senadores) trabajaron en conjunto con algunas Organizaciones de la Sociedad Civil (OSC). No
obstante, la sociedad civil especializada en temas migratorios tuvo poca incidencia. Del mismo modo,
al menos para las organizaciones que trabajan temas migratorios, el proceso de incidencia estuvo
considerablemente concentrado en el Distrito Federal. Tal y como lo muestra la gráfica 1,6 el 85.72% de
las organizaciones en materia migratoria que tuvieron participación activa en el proceso de Reforma
están basadas en el Distrito Federal.

Lo anterior puede ser una explicación al bajo conocimiento del contenido y de los alcances de la
Reforma Constitucional en Derechos Humanos que indicaron tener las organizaciones que trabajan
temas migratorios, como lo muestra la gráfica 2.7

(III) Reflexiones y retos a dos años de la Reforma
Como se muestra en el siguiente diagrama, la Reforma constitucional tiene 6 ejes fundamentales8:
1. Ampliación de Derechos;
2. Promocionar y difundir el conocimiento de los Derechos Humanos;
3. Especificar y ampliar la titularidad de los mismos;
4. Fomentar la utilización del derecho internacional en el marco normativo mexicano;
5. Reforzamiento normativo de derechos a través de la especificación de las obligaciones de las autoridades; y
6. Fortalecimiento de los instrumentos de ejecución tanto jurisdiccionales como no jurisdiccionales.

Ahora, si bien la Reforma constitucional en materia de derechos humanos de 2011 constituye un avance
para la promoción y protección de los Derechos Humanos en México, ésta no puede ser catalogada
como un logro total, pues aún existen limitaciones, ya sean normativas u operativas, sobre todo en el
aspecto migratorio. Para que se pueda decir que la Reforma es exitosa es necesario hacerse cargo de
los siguientes retos9, que son, medularmente 6:
Retos de la Reforma Constitucional
El primer reto es la implementación ejecutiva; es decir, es necesario que se efectúen, por parte de los
ejecutivos Federal y Local, una revisión de los mecanismos de aplicación de la Reforma Constitucional
que tienen a su alcance y que realicen los esfuerzos necesarios para que puedan vigilar y cooperar con
las implementaciones establecidas por el legislativo.
El segundo reto se refiere a la implementación legislativa. Tal como lo establece la Reforma en sus
artículos transitorios, se deben generar legislaciones secundarias pertinentes para que se puedan
hacer efectivos algunos de los derechos establecidos en la Reforma. Por ejemplo, respecto al artículo
1 constitucional, existe la opinión de que este requisito está cubierto con la Ley General de Víctimas
publicada el 09 de enero de 2013. Sin embargo, es cuestionable si esta ley es suficiente para regular
estos derechos.10 Asimismo, el exponente más claro es la ausencia de legislación secundaria del
artículo 33. Este problema es señalado por la sociedad civil. Por ejemplo, un miembro de Sin Fronteras
IAP afirma que:

“hay un debido proceso, pero no sabemos en qué consiste dicho debido proceso, ni
como empataría con el procedimiento administrativo en cuanto medio de defensa […]
siempre en las leyes reglamentarias es donde se ve la aplicación, y ahí suelen radicar los
obstáculos para la protección efectiva los derechos humanos de las personas”.11
En síntesis, por parte del poder legislativo se deben realizar las leyes reglamentarias para que se hagan
efectivos ciertos derechos. En específico los artículos 11 y 33 constitucional. Al respecto, en los compromisos
realizados en el Pacto por México (PxM)12 se acordaron dos puntos fundamentales en el compromiso 24 y el
compromiso 30, que tienen como límite de cumplimiento el segundo semestre de 2013:
“Compromiso 2413: Ley Reglamentaria del Artículo 33 Constitucional en materia de
expulsión de extranjeros”. En este compromiso lo que pretenden realizar es una nueva
ley que reglamente el procedimiento para que un extranjero pueda ser expulsado del
país garantizado en su totalidad el debido proceso y los derechos humanos.
Compromiso 3014: “Derechos de los migrantes”. Con este compromiso lo que se busca
es la ejecución de un política migratoria que defienda la decisión de migrar como un
derecho humano. Por lo tanto, se buscará defender los derechos de los migrantes
mexicanos en el exterior y migrantes extranjeros en el territorio nacional, luchando en
contra de su criminalización.
El tercer reto, la implementación judicial, consiste en la aceptación, por parte de los distintos Poderes Judiciales (federales y locales), de la normatividad internacional en su totalidad. Si bien se ha logrado que el Poder Judicial Federal utilice como directriz, en algunos casos, normatividad internacional, ésta se ha centralizado en el Sistema Americano de Derechos Humanos y no ha tomado en consideración los demás ordenamientos internacionales que podría tener a su alcance.
Este reto está estrechamente relacionado con el de la centralización de la Reforma constitucional (que se
explica a continuación), pues como lo afirma la Coalición Pro Defensa del Migrante de Baja California:
Las Reformas no se han difundido en absoluto a pesar de que el gobierno del estado se ha interesado. Desde hace un año se han hecho esfuerzos para la creación de un diagnostico en Derechos Humanos; sin embargo las instancias no jurisdiccionales no han asistido. Solo han ido los representantes de las asociaciones civiles. No hay conocimiento ni difusión en los medios.15

El cuarto reto se basa en la centralización de la Reforma. En este sentido, si bien se reconocen los
esfuerzos de las entidades federativas, aún existe poco conocimiento, tanto del contenido como de la
implementación de la Reforma, por lo que es indispensable trabajar a nivel local. Las organizaciones
de la sociedad civil que no tienen su sede en el Distrito Federal son conscientes de las dificultades que
esto implica, por ejemplo, FM4 Paso Libre (Dignidad y Justicia, A.C.) de Guadalajara Jalisco cuestiona:
“¿Cómo armonizamos esto a nivel local? También es una preocupación que tenemos a nivel regional,
todo está como muy centralizado en el Distrito Federal, desde la información hasta los procesos”.16
Al respecto, las Organizaciones de la Sociedad Civil participantes en el análisis, en general, mostraron su
preocupación en dos sentidos, el primero es ¿cuál va a ser el modo de aplicación de la Reforma en sus
localidades? Y el segundo ¿cómo puede armonizarse la Reforma con las necesidades de sus localidades?.
Estas dos cuestiones tienen mayor relevancia dado que el 40.63% de las OSCS en temas migratorios que
participaron en el proyecto no conocían la Reforma a los artículos 11 y 33.17 Por lo tanto, al encontrarse
centralizado el conocimiento y aplicación de la Reforma, será más difícil entender y aplicar las ventajas
que pudiera contener. Esta falta de conocimiento de la Reforma por las ONG’s basadas en las entidades
federativas se puede observar en la gráfica 3:

El quinto reto es la implementación internacional, que implica el reconocimiento sobre la importancia
de la supervisión internacional, ya que esto puede ayudar a evaluar, de forma externa, los avances o
deficiencias que se están teniendo en el marco y aplicación de los Derechos Humanos en México.
Finalmente, superar el sexto reto, es decir, la apropiación de la ciudadanía de la Reforma constitucional,
es indispensable. Debe existir una participación activa por parte de la ciudadanía no sólo del centro
del país, sino de las entidades federativas, para conocer la Reforma y exigir a las autoridades su
cumplimiento. Esto incluye un conocimiento extenso de la Reforma y no sólo limitarse al conocimiento
del artículo 1º constitucional. En este sentido, la población se debe identificar con la Reforma, no verla
como un instrumento ajeno a su realidad.
Superar este reto implica realizar campañas de difusión, conocimiento, capacitación para que las
personas puedan conocer sus derechos y obligaciones para que de esta manera puedan utilizar la
Reforma. Como se puede ver, se tratan de retos que implican modificar la cultura jurídica mexicana,
que deben de dar paso a un derecho más funcional que formal, así como más flexible que el estático
al que el país se encuentra acostumbrado y una participación activa por parte de la ciudadanía en el
proceso de apropiación de la Reforma.

(IV) Análisis teórico de los artículos 11 y 33 constitucional
Desde 1917, no se habían realizado Reformas a los artículos 11 y 33 constitucionales. En este apartado
se busca analizar los problemas que contienen la nueva redacción de estos artículos y el impacto que
trae consigo.
A. Análisis teórico del artículo 11 constitucional
El artículo 11 actualmente tiene la siguiente redacción:
Art. 11.- Toda persona tiene derecho para entrar en la República, salir de ella, viajar por
su territorio y mudar de residencia, sin necesidad de carta de seguridad, pasaporte,
salvoconducto u otros requisitos semejantes. El ejercicio de este derecho estará
subordinado a las facultades de la autoridad judicial, en los casos de responsabilidad
criminal o civil, y a las de la autoridad administrativa, por lo que toca a las limitaciones
que impongan las leyes sobre emigración, inmigración y salubridad general de la
República, o sobre extranjeros perniciosos residentes en el país.
En caso de persecución, por motivos de orden político, toda persona tiene
derecho de solicitar asilo; por causas de carácter humanitario se recibirá refugio.
La ley regulará sus procedencias y excepciones.
De esta redacción se pueden analizar tres problemas fundamentales. El primero es la permanencia de
la existencia de la figura “extranjeros perniciosos residentes en el país”; el segundo, la distinción entre
asilo y refugio y, el tercero, la imprecisión de términos en los motivos por los cuales se otorga cada
estatus.
La permanencia de la figura de “extranjero pernicioso” tenía sentido en el momento de su creación debido al contexto en el que se encontraba México.18Sin embargo, hoy no es posible seguir considerando esta figura dentro de nuestro marco jurídico, pues va en contra tanto de los compromisos adquiridos por México, de la nueva política exterior y, por lo tanto, de nuestra Constitución. Ejemplo de ello, son los múltiples tratados internacionales de apertura a la globalización tal como es el Tratado de Libre Comercio para América del Norte (TLCAN),19 el cual no operaría con el énfasis de que los extranjeros son peligrosos o perniciosos; también se puede analizar en los compromisos realizados por el Pacto

por México (PxM) el compromiso no. 30: “Derechos de los migrantes”,20 ya que, con este compromiso
se busca la ejecución de un política migratoria que defienda la decisión de migrar como un derecho
humano y se busca defender los derechos de los migrantes mexicanos en el exterior y migrantes
extranjeros en el territorio nacional, luchando en contra de su criminalización.
El segundo problema es la distinción entre asilo y refugio pues la Reforma presenta deficiencias
conceptuales, ya que, como será explicado, la distinción entre asilo y refugio está superada en términos
útiles. Para comprender estas figuras es necesario conocer su origen y sus efectos prácticos.
En América Latina ha existido una diferenciación entre los términos “asilo” y “refugio”. Históricamente,
el sistema jurídico interamericano se ha caracterizado por su tendencia a reconocer el derecho al
asilo diplomático, empezando en 1889 con el Tratado de Derecho Penal Internacional de Montevideo.
Esta tradición fue seguida por la Convención sobre Asilo de La Habana de 1928, la Convención sobre
Asilo Político de Montevideo de 1933 y la Convención sobre Asilo Diplomático de Caracas, de 1954.
Finalmente, el derecho al asilo quedó institucionalizado como derecho humano tanto por la Declaración
Americana de Derechos y Deberes del Hombre como por la Convención Americana sobre Derechos.
El enfoque inicial de este sistema estuvo orientado hacia personas perseguidas por cuestiones políticas
y culturales. Sin embargo, durante las décadas de los sesentas, setentas y ochentas este enfoque fue
puesto a prueba por la creciente afluencia de refugiados provenientes del Caribe. La inestabilidad
democrática de América Latina, las dictaduras en la región y las condiciones de vida provocaron
un aumento en los flujos migratorios a lo largo del continente. Fue en ese momento en el que la
incompatibilidad entre el sistema internacional de refugiados y el sistema interamericano de asilo
supuso un problema para la aplicación de protección internacional.
Sin embargo, a pesar de que esta diferencia responde a un marco conceptual e histórico definido en
la región, existe una confusión en el uso de ambos conceptos al momento de aplicar la protección
internacional para personas que deciden, por distintas razones abandonar su país de origen. Esta
confusión conceptual y terminológica constituye un síntoma de debilitamiento de la respuesta
institucional frente al problema de los refugiados en América Latina.
Con el paso del tiempo se ha ido consolidando un marco normativo favorable para la protección de
los refugiados comenzando con el reconocimiento de la Convención de 1951 y el Protocolo de 1967
sobre el Estatuto de los Refugiados y la creación de la Declaración de Cartagena sobre los Refugiados
de 1984. Sin embargo, en América Latina persiste la idea de que el término asilo se refiere al sistema
latinoamericano establecido en diversos tratados sobre asilo y extradición, y que el refugio corresponde

derecho internacional y del respeto a los derechos humanos han sido constantes. Puntualmente, la
Oficina del Alto Comisionado de las Naciones Unidas para los Refugiados ha reconocido que en América
Latina, “es necesario precisar el contenido del derecho al asilo a la luz del desarrollo progresivo del
derecho internacional de los derechos humanos mediante la realización de estudios orientados hacia
esa finalidad”.21
De la misma forma, Juan Carlos Murillo ex director de la Unidad Legal del Alto Comisionado de las
Naciones Unidas para los Refugiados para el continente americano comentó durante su gestión que
“ciertamente cuando hablamos de refugiados y la protección internacional que les brinda un Estado,
nos referimos a un estatuto o condición jurídica de un extranjero amparado por un régimen especial de
protección, donde la utilización común del término “refugio” resulta no sólo imprecisa sino simplista”.22
Esta distinción reconocida en el texto constitucional no sólo contradice el discurso innovador con el
que fue publicitada la Reforma, sino que revela el anticuado marco conceptual con el que el legislador
analiza las condiciones actuales de las personas migrantes.
El problema se hace más latente cuando se indican equivocadamente las causas en las que ambas figuras
pueden proceder, generando así el tercer problema, ya que se señala que el asilo resulta por causas
políticas, y el refugio, por causas humanitarias. En esta parte, la Reforma constitucional se aparta de los
instrumentos del derecho internacional. En primer lugar porque el así llamado “refugio” puede proceder
por persecución política, tal como los señala la Convención sobre el Estatuto de los Refugiados.23 Esta
contradicción es relevante porque se da también entre la Constitución y la Ley para Refugiados y
Protección Complementaria, a pesar de que ambos documentos fueron aprobados por la Cámara de
Diputados con una diferencia temporal mínima. Esta situación será abordada más adelante.
En cuanto a las deficiencias técnicas es importante mencionar que durante el proceso de Reforma fue
evidente la falta de coordinación legislativa. Durante la LXI Legislatura se discutieron al mismo tiempo,
aunque en distintas comisiones, las iniciativas de Ley sobre Refugiados y Protección Complementaria y
la Reforma constitucional en materia de Derechos Humanos. Sin embargo, pese a esta simultaneidad
“llama la atención que ambos procesos nunca hayan tenido puntos o momentos de encuentro”.24 La
muestra de esta falta de coordinación es que la Ley sobre Refugiados y Protección Complementaria, de
carácter secundario se publicó en el DOF el 27 de enero del 2011, 5 meses antes de que se aprobarán
la Reforma constitucional del artículo 11.

Esta diferencia temporal tuvo repercusiones sustanciales en la relación de ambos instrumentos. La
Ley sobre Refugiados y Protección Complementaria (en sintonía con la Convención sobre el Estatuto
de los Refugiados y su Protocolo de 1967) establece que la condición de refugiado se reconocerá a
todo extranjero que se encuentre en territorio nacional, y que “debido a fundados temores de ser
perseguido por motivos de raza, religión, nacionalidad, género, pertenencia a determinado grupo
social, opiniones políticas, violencia generalizada, agresión extranjera, conflictos internos, violación
masiva de los derechos humanos u otras circunstancias que hayan perturbado gravemente el orden
público, se encuentre fuera del país de su nacionalidad y no pueda o, a causa de dichos temores,
no quiera acogerse a la protección de tal país; o que, careciendo de nacionalidad y hallándose, a
consecuencia de tales acontecimientos, fuera del país donde antes tuviera residencia habitual, no
pueda o, a causa de dichos temores, no quiera regresar a él.25
Así pues, la Reforma al artículo 11 crea el riesgo de disminuir la protección internacional que México
otorga a las personas extranjeras. La imprecisión técnica en la redacción puede tener consecuencias
sustantivas al momento de resolver un caso de una persona que busque obtener la condición de
refugiado al amparo del derecho internacional en la materia, ya que tal estatus se puede otorgar sólo
por “causas de carácter humanitario”, cuyo contenido es incierto al no estar definido por el derecho
internacional. Así, resulta plausible suponer que una persona que ha huido de su país debido a
opiniones políticas, se le podría negar la condición de refugiado, pues resultaría difícil explicar por qué
tal situación constituiría una “razón de carácter humanitario”.26
Por todo lo anterior, la redacción al artículo 11 constitucional presenta limitaciones ya que continúa
contemplando la figura de “extranjero pernicioso”, la cual ya no tiene cabida en un Estado que busca
estar a la vanguardia internacional y no brinda protección a las personas migrantes, al contrario, limita
su protección a conceptos ambiguos y antiguos que hoy en día ya no son prácticos.
B. Análisis teórico del artículo 33 constitucional
La redacción del artículo 33 constitucional de la Reforma constitucional en materia de derechos
humanos es la siguiente:
Art. 33.- Son personas extranjeras las que no posean las calidades determinadas
en el artículo 30 constitucional y gozarán de los derechos humanos y garantías
que reconoce esta Constitución.

El Ejecutivo de la Unión, previa audiencia, podrá expulsar del territorio nacional a
personas extranjeras con fundamento en la ley, la cual regulará el procedimiento
administrativo, así como el lugar y tiempo que dure la detención.
Los extranjeros no podrán de ninguna manera inmiscuirse en los asuntos políticos
del país.
Asimismo, el artículo Quinto Transitorio del Decreto de la Reforma Constitucional de 2011 establece:
Quinto. El Congreso de la Unión expedirá la Ley Reglamentaria del artículo 33
constitucional, en materia de expulsión de extranjeros en un plazo máximo de un
año contado a partir del inicio de la vigencia de este decreto. En tanto se expida la
ley referida, este artículo se seguirá aplicando en los términos del texto vigente.
Este artículo, al igual que el 11 constitucional presenta dos problemas. El primero, la constitucionalización
de la detención a extranjeros. El segundo, la ausencia de una Ley Reglamentaria que haga vigente el
nuevo artículo y resuelva los problemas que éste presenta.
La constitucionalización de la detención a extranjeros no tiene antecedentes, pues es la primera vez
que aparece en la Constitución como se expondrá a continuación. Por ejemplo, en la Constitución
Política de la República Mexicana del 1857, no se estableció previsión semejante, únicamente se
hacía referencia a la obligación de los extranjeros “de respetar las instituciones, leyes y autoridades
del país, sujetándose a los fallos y sentencias de los tribunales, sin poder intentar otros recursos que
los que las leyes conceden a los mexicanos”.27 Asimismo, en la Constitución anterior a la Reforma el
texto era el siguiente:
Art. 33.- Son extranjeros los que no posean las calidades determinadas en
el artículo 30. Tienen derecho a las garantías que otorga el Capítulo I, Título
Primero, de la presente Constitución; pero el Ejecutivo de la Unión tendrá la
facultad exclusiva de hacer abandonar el territorio nacional, inmediatamente
y sin necesidad de juicio previo, a todo extranjero cuya permanencia juzgue
inconveniente.
Los extranjeros no podrán de ninguna manera inmiscuirse en los asuntos políticos
del país.
En dicho artículo tampoco se consideraba la detención de extranjeros. Sin embargo, a pesar de lo
anterior, el legislador actual consideró prudente constitucionalizar la detención a los extranjeros, 27 Constitución Política de la República Mexicana de 1857, artículo 33.
al indicar que la ley regulará el lugar y tiempo que dure la detención. Así, la Reforma lejos de ser
progresiva, podría tener un carácter regresivo. 28
Esto resulta aún más contradictorio considerando que en la exposición de motivos de la Reforma29 el
legislador estableció que se hacía ésta con el fin de proteger la garantía de audiencia de los extranjeros
en los casos de expulsión; es decir, en una interpretación amplia de esta afirmación, buscaba proteger
en general a los extranjeros. Por todo lo anterior, sigue siendo cuestionable y poco claros los motivos
por los cuales el legislador decidió constitucionalizar la detención de extranjeros.
El segundo problema es la ausencia de una Ley Reglamentaria. La modificación al artículo 33
contemplada en este paquete se orientó a delimitar la capacidad del Ejecutivo para promover la
expulsión de extranjeros, sometiendo esta decisión a una audiencia previa de carácter obligatorio. Este
mecanismo garantiza dos cosas: la primera, que las personas extranjeras tendrán la certeza jurídica al
conocer la intención del Estado mexicano de expulsarlos. La segunda, que con una audiencia se abre
la posibilidad para que las personas extranjeras puedan impugnar la resolución emitida. Esta Reforma
significó un avance en el respeto a los derechos humamos de los extranjeros y puntualmente el respeto
al debido proceso ya que “cada persona independientemente de su nacionalidad, que se vea afectada
de modo adverso por un acto de autoridad es titular de los siguientes derechos fundamentales:
a) Fundamentación y motivación de los actos de autoridad […]
b) Derecho de audiencia” 30
Sin embargo, los efectos positivos que hubieran podido haberse generado por esta modificación
constitucional quedaron estancados por el transitorio Quinto del Decreto de Reformas pues limitó
la eficacia de los posibles avances de la modificación al 33 constitucional, sometiendo los efectos de
la Reforma a la voluntad del legislador de emitir una ley secundaria, la cual hasta la fecha, no ha sido
expedida a pesar de que la fecha establecida se rebasó aproximadamente hace un año.
La aplicación eficaz de las normas depende de la existencia de los mecanismos jurídicos necesarios.
La diferencia entre normas primarias (como el artículo 33 de la Constitución) y secundarias (como
su Ley reglamentaria) radica en que las primeras imponen obligaciones debido a que tienen fuerza
compulsiva, estableciendo conductas que se consideran deseables, mientras que las segundas se
ocupan de la delimitación operativa del precepto establecido en las normas primarias.31 De ahí que

jurídicamente, los efectos de la Reforma al artículo 33 queden en buenas intenciones y no en preceptos
jurídicos operativos y eficaces.
Por lo tanto, a pesar de la Reforma, la ausencia de una Ley Reglamentaria provoca que la redacción
vigente del artículo 33 constituya una violación a los derechos humanos y un incumplimiento del
derecho internacional, generando responsabilidad estatal para México pues como lo estableció la
Corte Interamericana: “La ausencia de un recurso efectivo por violaciones de los derechos reconocidos
por la Convención es en sí misma una violación de la Convención por el Estado parte en donde tal
recurso se encuentre ausente. En ese sentido, cabe destacar que, para que tal recurso exista, no basta
con que esté previsto por la Constitución o por la ley o con que sea formalmente admisible, sino
que se requiere que sea realmente efectivo para establecer si ha habido una violación a los derechos
humanos y para proveer una reparación”.32

Conclusiones
La Reforma Constitucional en Derechos Humanos es un punto de partida y no un puerto de llegada.
Aún existen diversas tareas pendientes para que sus efectos se materialicen en la vida cotidiana. Por
ejemplo, su implementación Ejecutiva; Legislativa y Judicial; el conocimiento e implementación de la
Reforma a nivel federal y local; y un proceso de apropiación de la ciudadanía en general, de la Reforma
constitucional.
Por otra parte, entre los retos más relevantes destaca el poco conocimiento que tienen de la Reforma
Constitucional de Derechos Humanos las Organizaciones de la Sociedad Civil en materia migratoria. La
falta de este conocimiento dificulta su aplicación y por lo tanto, abre más la brecha en la identificación

Executive Summary
Much has been said about the 2011 Constitutional
Amendment on Human Rights. Primarily, the
analysis has focused on the legal virtues of the
constitutional amendment as a new paradigm.
Again, the positivist analysis of constitutional
norms has prevailed. However, there is little written
of the practical effects that the Amendment brings
to the daily life of people in the country, especially
those who are vulnerable, including migrants.
Similarly, the tendency for analyses is to view
the Amendment from a generally central legal
perspective, which assumes that the reality of
the country is centered around the capital with a
government that implements its laws.
This paper aims to turn the analysis of the 2011
Constitutional Amendment on Human Rights
towards a more practical and national level, from
the perspective of civil society organizations
working on migration issues. To this end, the project
convened five focus groups made up of civil society
organizations, activists and experts on migration
from various parts of Mexico.
Among this project’s main findings: the consultation
process for the Constitutional Amendment was
largely limited to migration organizations based
in Mexico City. This could serve as a reason for
the low awareness of the content and scope of
the Constitutional Amendment on Human Rights
reported by civil society organizations working on
migration issues. Given this reality, this document
suggests that deeper ownership of the Constitutional
Amendment by citizens in general is essential to its
success. In order to understand the Constitutional
Amendment and demand compliance by the
authorities, there must be active participation by
citizens not only in the country’s capital, but that of
all states. This includes deepening understanding of
the full Amendment and not just limited to Article 1
of the Constitution.
As citizens, and not just lawyers, take ownership of
the Amendment, we can begin looking to advances
in human rights in the country. It is important to
note that this document does not diminish the
legal analyses, or the virtues of the Amendment.
However, it considers the Constitutional Amendment
a starting point and not a point of arrival. There
are still several challenges remaining, such as the
need for implementation at the executive and
judicial levels, as well as national and international
monitoring of its implementation. As long as these
issues remain unchallenged, it will be difficult to
state that the Amendment has changed the social
reality of Mexico.
Introduction
On June 10, 201l, the Federal Official Gazette
(Diario Oficial de la Federación, DOF) published an
amendment to various constitutional provisions on
human rights in Mexico. Since then, it has become
common to state that such amendment is a pivotal
step towards the promotion and protection of
human rights in Mexico.1 However, two years
since its publication, it is important to analyze the
practical effects, benefits and limitations of its
implementation. For example, as discussed later,
the migration aspects have not yet been able to
obtain the results that would favor migrants.2
Given this situation, the Institute of Economic
Research of the National Autonomous University
of Mexico (Universidad Nacional Autónoma de
México) and Sin Fronteras, sponsored by the
European Union, performed an analysis of the
migration amendment, focused on identifying the
existing challenges and recommending possible
solutions.
This document is a study of the implications and
challenges of the Constitutional Amendment on
Human Rights in light of the current regulatory
framework on migration. This document is divided
into four sections. The first section describes
the project’s methodology, the second section

(I) Methodology
A participative analysis framework was used to conduct an impact assessment of the 2011 Constitutional
Amendment on Human Rights, in terms of migration issues. The purpose of this stage of the project is to
increase the articulation and exchange of information between civil society organizations, academia and
national experts in order to identify the challenges and implications of the Amendment.
The information gathered stemmed primarily from focus groups with participants from various parts of the
country, in order to identify a wide array of the Amendment’s challenges, successes and impact, from the
perspective of civil society. The project was designed so that participants’ impact would be the greatest
possible. For this reason, civil society organizations across the country working on migration issues were
invited to participate in the analysis. Although conflicting schedules limited participation, the project was
able to reach a representative number of civil society organizations specializing on migrant human rights.
A total of 56 project assistants participated in the focus groups and an academic forum. The participants
were from Baja California, Chiapas, Distrito Federal, Guadalajara, Guanajuato, Querétaro, Saltillo, Veracruz
and Zacatecas.3
During the focus groups, project assistants were divided into five groups. Participants were divided
into regional sections, forming focus groups representing the northern, southern and central parts of
the country, while two other groups were mixed. All groups were presented with an overview of the
Amendment content, which was used as a foundation to guide the subsequent group reflections.
One of the most important insights collected during these focus groups was the fact that 40.63% of the
participating CSOs did not fully understand the Amendment and only 59.37% had a deeper understanding.
This lack of understanding presented an obstacle to being able to identify subsequent issues and challenges
with the Amendment. Given this situation, the project added a forum with a panel of academic experts
who explained all the relevant aspects of the Amendment in detail. This forum served as a reflective
closing for the focus groups. The forum was presided by the following migration experts:

The Constitutional Amendment on Human Rights reformed Articles 1, 3, 11, 15, 18, 29, 33, 89, 97, 102 and
105 of the Constitution of the United Mexican States.4 The following table shows the pre-Amendment

B. Civil Society and the Amendment process: Critical Insights
During the Constitutional Amendment process, legislators (from both the House of Representatives
and Senate) collaborated with some CSOs. However, civil society organizations specializing on migration
issues had little influence.5
Similarly, for organizations working on migration issues, the consultation process for the Amendment
was largely limited to those based in Mexico City. As Graph 1 illustrates below, 85.72% of the composition
of organizations specializing on migration topics that actively participated in the Amendment process
are based in Mexico City.

The above finding could serve as an explanation to the low levels of understanding of the Constitutional
Amendment on Human Rights content, identified by the migration CSOs as illustrated on Graph 2.6

(III). Reflections and challenges, two years since the Amendment
As illustrated in the following diagram, the constitutional amendment revolves around 6 critical axes:7
1. Amplify rights;
2. Promote a greater understanding of human rights;
3. Outline the specific content of certain rights and increase the number of people who can
claim them;
4. Foster the use of international law framework in Mexican normative procedures;
5. Reinforce a normative rights framework by detailing authorities’ responsibilities; and
6. Strengthen judicial and non-judicial implementation tools.

While the constitutional amendment is an important advance for the promotion and protection of
human rights in Mexico, it is far from a success given the existing normative and operational limitations,
especially in terms of migration themes.
In order for the amendment to be successful, it is necessary to tackle the following challenges:
Challenges to the Constitutional Amendment
The first challenge lies in the executive implementation; it is necessary for the federal and local
branches to conduct a review of the enforcement mechanisms and take the necessary actions in order
to monitor and comply with the implementation standard established by the legislature.
The second challenge relates to the legislative implementation. According to the amendment,
in its transitionary provisions, implementing legislation must be developed in order to make the
constitutional provisions effective. For example, in terms of article 1 of the Constitution, it is widely
believed that the Victim Protection Act (Ley General de Víctimas), enacted on January 9, 2013, covers
this requirement.8However, it is questionable whether this law is sufficient to regulate these rights.
Furthermore, Article 33 demonstrates the clearest example of the lack of implementing legislation. A
member of Sin Fronteras, IAP, states:
“there is due process, but we do not know what it consists of, nor how it would merge with the
administrative procurement in terms of defense […] the regulatory laws always reflect its application,
and that is where the obstacles tend to arise for the effective protection of human rights.”9

In summary, as far as the legislative power is concerned, it must develop laws in order to implement
certain rights - specifically, it must develop implementing legislation for constitutional articles 11 and
33. In Pacto por México (PxM),10 Commitment 24 and Commitment 30, are two key points that were
agreed upon, which are due to by the second semester of 2013:
“Commitment 2411: Implementing legislation of Article 33 on the expulsion of aliens.”
This commitment seeks a new law regulating the procedure for a foreigner’s deportation,
ensuring a fully guaranteed due process and protection of human rights
“Commitment 3012: Rights of Migrants.” This commitment seeks the execution of a
migration policy that defends the decision to migrate as a human right. Therefore, it
calls for the defense of the rights for Mexican migrants abroad and foreign migrants
within the country, against their criminalization.
The third challenge, the judicial implementation, consists on the full acceptance of international norms
by various judicial powers (federal and local). While the federal judiciary uses the amendment as a
guideline, in some cases it has been centralized in the Interamerican System of Human Rights and not
taken the international system into account.
This challenge is closely tied to centralization issues behind the amendment (which will be elaborated
further, below). As noted by the Coalition for the Defense of migrants, Baja California:
“The amendments have not been disseminated at all even though there was interest by
the state government. For the past year, there have been efforts to establish a diagnosis on
human rights; however, the non-judicial bodies have not attended. The only attendees have
been representatives of civil society associations. There is no knowledge or dissemination in
the media.”13
The fourth challenge is based on the federal centralization of the amendment. Although the federal
entities have made efforts, there is still little knowledge of both the content and implementation of
the amendment. It is therefore essential to work locally. The civil society organizations not based in
Mexico City are aware of the difficulties involved. For example, FM4 Paso Libre (Dignidad y Justicia,
A.C.) Guadalajara, Jalisco questions: “How do we harmonize this law? It is also a concern that we have

at the regional level, everything is highly centralized in Mexico City, from information to processes”. 14
Civil society organizations involved in the analysis expressed concern in two ways; the first concerns
the application of the Amendment in their localities. The second issue revolved around how the
amendment may be harmonized with the needs of their localities.
These two issues are further exacerbated by the fact that 40.63% of CSOs participating in the project
were unaware of articles 11 and 33.15 Therefore, given the centralized and isolated understanding of
the amendment, it will be more difficult to understand and apply the advantages that the amendment
might present. This lack of understanding by CSOs is shown in Figure 3:

The fifth challenge is the international implementation, given that it is necessary to acknowledge the
importance of international supervision as this can help externally assess progress or deficiencies by
the framework and implementation of human rights in Mexico.
Finally, the sixth challenge extends to broader civilian ownership and participation of the constitutional

amendment. Active participation of all citizens and federal entities is indispensable in order to
demand authorities’ duties to fulfill their obligations. This includes an extensive understanding of the
amendment and not simply limit it to article 1 of the constitution. In this sense, the general public must
identify with the amendment and not simply see it as a tool external to their reality.
Overcoming this challenge implies conducting publicity campaigns and offering trainings so that people
are aware of their rights and obligations so that they can use the amendment as a tool to promote
change to benefit society. These are challenges that imply changing Mexico’s legal culture, which must
give way to rights that are more functional than formal and must therefore be more adaptive than
static in manner, along with active participation by the country’s citizens.

(IV). Theoretic Analysis of Constitutional Articles 11 and 33
Since 1917, there had been no amendments to constitutional articles 11 and 33. This Project seeks to
analyze problems contained by the new iteration of these articles and the subsequent impact.
A. Theoretical Analysis of Constitutional Artcle 11
Article 11 currently contains the following:
Art. 11 – Every person has the right to enter and leave the country, to travel through
its territory and to change residency without the necessity of a letter of safe passage,
passport, safe conduct or any other similar requirement. In the event of criminal or
civil liability, the exercise of this right shall be subject to the judicial authority which
will abide by limitations imposed by the laws on immigration, emmigration and public
health, or in respect to undesirable aliens residing in the country.
In case of political persecution, any person has the right to seek political asylum,
which will be provided for humanitarian reasons. The law shall regulate the cases
in which political asylum should be provided, as well as the exceptions.
Three fundamental problems arise in this article. The first is the permanence of the term “undesirable
aliens residing in the country,” the second is the distinction between asylum and refuge and, third, the
vagueness of terms of the grounds on which each status is given.
The use of the term “pernicious foreigner” made sense at the time of the article’s creation because of
the historical context in Mexico.16 However, today it is not possible to continue with this legal framework
because it goes against the commitments made by Mexico’s new foreign policy and, therefore, our
Constitution. This is observed through the many international treaties such as the North America Free
Trade Agreement (NAFTA),17 which could not operate if foreigners were dangerous or harmful; or through
the commitments in PxM, No. 30: “Rights of Migrants,”18 since this commitment seeks to implement a
migratory policy that defends the right to migrate as a human right and defends Mexican migrant rights
abroad and foreign migrants in the country, fighting against their criminalization.

The second problem lies the distinction between asylum and refuge because the distinction between
these two terms is outdated. In order to understand these figures it is necessary to know their origin
and practical effects.
In Latin America there is a distinction between the terms “asylum” and “refugee” status. Historically, the
Interamerican legal system is characterized by its tendency to recognize the right of diplomatic asylum,
starting in 1889 with the Montevideo Treaty of International Penal Law. This tradition was followed
by the Convention on Asylum, (1928); the Convention on Political Asylum and the 1933 Montevideo
Convention on Diplomatic Asylum, 1954. Finally, the American Declaration of Rights and Duties of Man
and the American Convention institutionalized the right to asylum as a human right.
This system was originally focused on persons persecuted for political and cultural issues. However, during
1960s, ‘70s and ‘80s this approach was tested by the growing influx of refugees from the Caribbean.
The Latin American democratic instability, the dictatorships in the region and living conditions led to an
increase in migration flows across the continent. It was at this time that the incompatibility between
the international system of refugee status and the American asylum institution presented a problem
for the application of international protection.
However, even though this difference reflects a conceptual and historical framework defined in the
region, there is confusion in the use of both concepts when applying for international protection
for people who decide, for various reasons, to leave their country of origin. This conceptual and
terminological confusion is proof of weakness of the institutional response to the problem of refugees
in Latin America.
A more favorable regulatory framework for the protection of refugees has been developing, starting
with the recognition of the 1951 Convention and the 1967 Protocol relating to the Status of Refugees
and the creation of the 1984 Cartagena Declaration on Refugees. Nevertheless, in Latin America the
idea persists that “asylum” refers to the term established in Latin American following various treaties
on asylum and extradition, and that “refugee” corresponds to the definition practiced by the United
Nations system. Efforts to standardize both concepts within the framework of international law and
respect for human rights have been constant. Specifically, the Office of the UN High Commissioner
for Refugees has recognized that in Latin America, “it is necessary to specify the content of the right
to asylum in light of the progressive development of international law of human rights by conducting
studies aimed towards this end.”19

Similarly, Juan Carlos Murillo, former director of the Legal Office of the UN High Commissioner for
Refugees for America, said, “certainly when we talk about refugees and international protection
afforded to them by a state, we refer to a statute or legal status of an alien covered by a special
protection regime where the common use of the term “refugee status” is not only inaccurate but
simplistic.”20 This distinction recognized in the Constitution reveals the outdated conceptual framework
in which the legislator analyzes the current conditions of migrants.
The problem becomes latent when the causes in which both figures can proceed are mistakenly
defined, resulting in a third problem, which signals that asylum is for political reasons, and refugee
status for humanitarian reasons. Here, the constitutional amendment departs from the instruments
of international law. First of all, refugee status can proceed by political persecution, as established in
the 1951 Convention on the State of Refugees.21 This contradiction is important because it also occurs
between the Constitution and the Law on Refugees and Complementary Protection, despite the fact
that the House of Representatives approved both documents with a minimum time difference.
In terms of the technical deficiencies, it is important to mention that during the amendment process,
the lack of legislative coordination was evident. During the LXI Legislature, the Refugee Complementary
Protection Act and the constitutional amendment on human rights were being drafted at the same
time, although in separate commissions. Despite this simultaneous timing, “it is remarkable that both
processes never had any meeting points”.22 The proof of this lack of coordination lies in the Law on
Refugees and Complementary Protection, an implementing law legislation published in the Official
Gazette on January 27, 2011, five months before article 11’s constitutional Amendment.
This temporal difference had a substantial impact on the relationship between the two legal tools.
The Law on Refugees and Complementary Protection (in line with the Convention on the Status of
Refugees and its 1967 Protocol) states that the refugee status will be applied to any alien who is in
the country, and who “owing to well-founded fear of being persecuted for reasons of race, religion,
nationality, gender, membership of a particular social group, political opinion, generalized violence,
foreign aggression, internal conflicts, massive violation of human rights or other circumstances which
have seriously disturbed public order, is outside the country of his nationality and is unable or, owing to
such fear, is unwilling to avail himself of the protection of that country, or who, not having a nationality
and being a result of such events, outside the country of former habitual residence usual, is unable or,
owing to such fear, unwilling to return to it.”23

Thus, the amendment of article 11 creates the risk of decreasing the international protection granted
to migrants in Mexico. Technical drafting imprecisions can have substantial consequences when
attempting to seek refugee asylum under international law, since refugee status is only granted for
“humanitarian reasons” whose content is unclear since it is not defined by international law. Thus,
it is plausible to assume that a person who has fled their country based on political opinions may be
denied refugee status, as it would be difficult to explain why such a situation would be a “humanitarian
reason”.24
For all the aforementioned reasons, Article 11 presents limitations since it is premised on the concept of
a “pernicious foreigner,” a term that no longer has a place in a state that seeks to be at the international
forefront while not protecting migrants. On the contrary, continued use of this term limits its protection
to ambiguous and antiquated concepts that are no longer practical.
B. Theoretical Analysis of Constitutional article 33
The constitutional amendment of Article 33, as it relates to human rights, states the following:
Art. 33 - Individuals lacking the qualities determined by Article 30 are
deemed foreigners and shall be entitled to the human rights and guarantees
conferred by this Constitution.
The President of the Republic shall have the power to expel any foreigner
from national territory following a hearing, in accordance to the law. The
law shall establish the administrative procedure, as well as the place where
the foreigner should be detained and the detention period. Foreigners are
forbidden from interfering in the country’s political affairs.
Similarly, Article V. of the 2011 transitory provisions establishes:
Fifth. The Congress of the Union shall enact the statutory law of article 33 of
the Mexican Constitution, regarding the expulsion of foreigners within one
year of the date when this decree comes into force. Meanwhile, Article 33
will be applied according to the current text.
This article, like Article 11, presents two problems. The first one is the Constitutional recognition of the
detention of aliens. The second is the absence of an effective regulatory law to implement the new

The constitutionalization of the detention of aliens is unprecedented, as it is the first time it appears
in the Constitution, as shall be discussed below. For example, in the 1857 Political Constitution of the
Mexican Republic, there was no such provision. It solely referenced foreigners’ duty to “respect the
institutions, laws and country authorities, subject to trial and punishment without the use of other
resources not granted to Mexicans by law.”25 Similarly, the previous version of the Constitution stated
the following:
Art. 33. Individuals are entitled to the guarantees granted by Chapter I,
Title I, of the present Constitution; but the Federal Executive shall have the
exclusive power to compel any foreigner to leave the country, immediately
and without the necessity of previous legal action, to whomever is deemed
inconvenient.
Foreigners are forbidden from interfering in the country’s political affairs.
The article did not consider the detention of aliens. However, the current legislature considered it
prudent to constitutionalize the detention of foreigners, indicating that an implementing law will
determine the place and period of detention. Thus, the amendment, far from progressive, could
potentially have a regressive impact.26
This results in further contradiction considering that the legislative cited wanting to guarantee due
process for foreigners as the reasoning behind the amendment. The legislative’s motives, however, are
still questionable and remain unclear. While on the one hand, if the intent of Amendment is to protect
foreigners, as listed above, the same Amendment is used to detain them.
The second problem is the absence of implementing legislation. The modification of Article 33
examined in this document focused on defining the capacity of the Executive to promote the expulsion
of foreigners, submitting this decision to mandatory preliminary hearing. This mechanism ensures two
things: first, that foreigners have the right to know of the intention of the Mexican state to expel them.
The second, a public hearing opens the possibility for foreigners to challenge the decision issued. This
amendment was a step forward in securing foreigners’ human rights, including due process, since
“every person regardless of nationality, who is adversely affected by an act of authority is entitled to
the following fundamental rights:
a) Rationale and reasons for authority acts [...]
b) Right to be heard27

However, the positive effects that might have been generated by this constitutional amendment
were stalled as a result of the Fifth transitory article, since it limited the effectiveness of the possible
developments of the 33 constitutional amendment. The amendment is subject to the will of legislature
to pass an implementing law, which to date has not been issued even though the due date passed
approximately a year ago.
The effective implementation of rules depends on the existence of legal mechanisms. The difference
between primary rules (such as Article 33 of the Constitution) and implementing laws (such as
regulatory law) is that the first establish obligations because they have compelling force, establishing
behaviors that are considered desirable, while the latter are concerned with the operational definition
of the rule established in the primary rules.28 Hence, the amendment of Article 33 is solely a statement
of purpose with good intentions, but is not operational as a legal precept.
Therefore, despite the Amendment, the lack of a regulatory law means that the current version of
Article 33 constitutes a violation of human rights and a breach of international law, creating state
responsibility for Mexico because, as established by the Interamerican Court:
“The absence of an effective remedy for violations of the rights recognized by the Convention
is itself a violation of the Convention by the State party in which such remedy is absent. In this
regard, it is noteworthy that, for such a remedy to exist, it is not enough that it be provided
by the Constitution or by law or that it be formally recognized, but rather it must be truly
effective in establishing whether there has been a violation of human rights and to provide a
remedy.”29

Conclusions
The Constitutional Amendment on Human Rights is a starting point and not a point of arrival. There
are still many tasks remaining in order for its full effects to materialize in everyday life. For example,
implementation at the Executive, Legislative and Judicial levels; deepening Amendment knowledge
and implementation at the federal and local levels; and a process of ownership by citizens in general.
Moreover, one of the most important challenges identified highlights the lack of understanding that
civil society organizations specializing on migration themes have of the Constitutional Amendment.
The lack of this knowledge makes it difficult to implement the law and therefore, widens the gap in
being able to identify other problems that can arise between the “is and ought” of the law. In other
words, between what is enshrined in the Constitution and the reality.
Finally, the document also analyzed the strictly legal challenges facing the amendment. For example,
the permanence of the existence of the phrase “undesirable aliens residing in the country,” or the
distinction between asylum and refugee contained in article 11 of the Constitution.
