Desde que supimos e informamos sobre la detencin, arresto y condena de la periodista independiente y bloguera DaniaVirgen Garca, hemos confiado en los trmites y las gestiones por parte de la Asociacin Jurdica Cubana y losperiodistas y colegas de Dania, quienes han hecho todo lo posible a su disposicin por ayudarla durante esta difcilsituacin.

Cuando una persona es arrestada, juzgada y condenada por un incidente exigimos que se observen lo sealado en laDeclaracin Universal de los Derechos Humanos (Artculos 6, 7, 8, 9, 10 y 11) que garantizan los derechos

fundamentales de proteccin bajo un sistema de ley para cada ser humano.1

No es admisible que el carcter e integridad de un ser humano sea juzgado y condenado en sitios o medios decomunicacin donde sealamientos de opiniones o pensamiento polticos son el enfoque, con carcter de opinin y nofactual, y en cuales no se observa o garantiza la igualdad de proteccin bajo un sistema jurdico como se requiere enobservacin a los derechos humanos fundamentales.

Nuestro principal objetivo es asegurarnos del bienestar de Dania (por su salud corporal y mental) y verificar que susderechos humanos fundamentales no hayan sido violados en el proceso policial y judicial que se ha realizado.

No aceptamos las interpretaciones que se han difundido y publicado y en ciertas circunstancias se han distorsionado,

sobre los hechos reales en lo relacionado a lo que le ha sucedido a nuestra apreciada y respetada periodista, DaniaVirgen Garca.

Tampoco aceptaremos interpretaciones ni distorsiones sobre la participacin de familiares de Dania en los sucesos,porque se debe observar el cumplimiento de los derechos prescriptos en la Declaracin Universal de los Derechos

Humanos (Artculos 3, 12 y 16) y se debe respetar la santidad de la familia y la relacin entre padres e hijos.2

Cualquier informacin sobre los sucesos relacionado al caso o situacin en cual se encuentra Dania, la compartiremos deforma razonable y responsable a travs de su blog:http://daniavirgengarcia.blogspot.com.

En El Blog de Dania compartiremos informacin sobre su estado y tambin incluiremos el trabajo de periodistas colegasde Dania que continuaran realizando el mismo periodismo que Dania ejerca en Cuba antes de ser privada de sulibertad.

Since we learned and informed others of the detention, arrest and conviction of independent journalist and bloggerDania Virgen Garca, we have trusted the efforts and procedures undertaken by theAsociacin Jurdica Cubana(Cuban Judicial Association), as well as journalists and colleagues ofDania, who have done everything possible withintheir means to help her during this difficult situation.

When a person is arrested, tried and sentenced for an incident, we request strict observance of the principles set forth inthe Universal Declaration of Human Rights (Articles 6, 7, 8, 9, 10 and 11) which guarantee every human being

certain fundamental rights and protection under a fair legal system.1

It is not acceptable that the character and integrity of a person be judged and condemned in the media or othercommunication sites where political opinions or ideas are the central focus, characterized by opinion and not fact; and

where adherence to equal protection under the law as required by these fundamental human rights cannot be guaranteed.

Our principal concern is to ensure the well-being ofDania (her physical and mental health) and to verify that during thepolice and judicial process to which she was subjected, that none of her fundamental human rights were violated.

We do not accept or recognize certain interpretations of the events that took place which have been published andbroadcast, and in some instances have been distorted, regarding what actually happened to our well-liked and respectedjournalist, Dania Virgen Garca.

Likewise, we do not accept or recognize any interpretations or distortions on what role or involvement Danias familymay have played in the events which took place, because we insist on the observance and compliance with the rightsprescribed in the Universal Declaration of Human Rights (Articles 3, 12 and 16) and request respect for the sanctity

of the family and the relationship between parent and child. 2

Any information on events related to the case or Danias state of being, will be shared in a reasonable and responsiblemanner via her blog:http://daniavirgengarcia.blogspot.com.

Through the Blog for Dania we will share information about her present condition, and will also include the work offellow journalists and colleagues ofDania, who will continue to undertake the same news reporting in Cuba that shecarried out prior to being deprived of her liberty.

1 Universal Declaration of Human Rights:Article 6:Everyone has the right to recognition everywhere as a person before the law.Article 7:All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protectionagainst any discrimination in violation of this Declaration and against any incitement to such discrimination.Article 8:Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him bythe constitution or by law.Article 9:No one shall be subjected to arbitrary arrest, detention or exile.Article 10:Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of hisrights and obligations and of any criminal charge against him.Article 11: 1) Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial atwhich he has had all the guarantees necessary for his defense.2) No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or

international law, at the time when it was committed. Nor shall a heavier penalty be imposed that the one that was applicable at the time the penaloffence was committed.

2 Universal Declaration of Human Rights:Article 3:Everyone has the right to life, liberty and the security of person.Article 12:No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor attacks upon his honour andreputation.
